Conflicto de competencia suscitado entre el Juzgado 7 Administrativo de Santa Marta y el Juzgado 4 Promiscuo Municipal de Ciénaga (Magdalena).
La controversia entre los precitados despachos tuvo su origen en las diferentes interpretaciones del factor territorial.
Ambos formularon una serie de argumentos relacionados con el lugar donde se presentó y tuvo sus efectos la vulneración de derechos alegada por la parte demandante.
La Sala Plena de la Corporación encontró que le asistía razón a las dos autoridades judiciales al considerar que carecían de competencia, por cuanto ninguna de ellas resultó ser territorialmente competente para conocer el asunto.
Con base en lo anterior, se envió el expediente de la referencia a la Oficina Judicial de Reparto de Bogotá, para que distribuya el asunto en aplicación del artículo 37 de Decreto 2591 de 1991.
